JobWorth Terms of Use
1. About these Terms
These Terms of Use (“Terms”) apply to your access to and use of JobWorth, including the JobWorth mobile application, website, beta program and related services.
JobWorth is developed and operated by Buzz Business Boosters (“JobWorth”, “we”, “us” or “our”).
By accessing or using JobWorth, you agree to these Terms.
If you use JobWorth on behalf of a business or organisation, you confirm that you are authorised to use JobWorth for that business or organisation.
2. What JobWorth does
JobWorth is a business costing and quoting support tool.
It is designed to help operators bring together information such as labour, materials, products, vehicles, fuel, travel, machinery, equipment and other relevant costs so they can better understand the estimated cost of a job before deciding what to quote.
JobWorth may also provide functions such as document-assisted price updating, route calculations, quote creation, quote sharing, business setup assistance and other related tools.
3. JobWorth does the maths. You make the decision.
JobWorth provides calculations, estimates, suggestions and information to assist your business decisions.
You remain responsible for:
- information entered into JobWorth;
- checking that costs, rates, quantities, distances, tax settings and other inputs are appropriate;
- reviewing information extracted or suggested from invoices, receipts or other documents;
- deciding whether to accept suggested cost updates;
- determining your final quote or selling price;
- reviewing customer-facing quotes before sending them;
- determining whether a job is commercially appropriate for your business;
- complying with tax, accounting, licensing, employment, safety and other obligations relevant to your business.
JobWorth does not make the final pricing decision for you.
4. Estimates and calculations
JobWorth calculations depend on the information available to it and the information you provide.
Actual job costs and outcomes may differ because of matters including:
- changes in labour time;
- route or travel changes;
- fuel prices;
- supplier price changes;
- wastage;
- unexpected work;
- vehicle or machinery costs;
- taxes or charges;
- incorrect or incomplete information;
- circumstances outside JobWorth’s control.
You should review important information before relying on a calculation or sending a quote.
JobWorth does not guarantee that a particular quote will be profitable or that actual job costs will equal the calculated estimate.
5. Not accounting, tax, legal or financial advice
JobWorth is not an accounting, bookkeeping, tax, legal or financial-advice service.
Information and calculations provided by JobWorth are business-support tools and are not a substitute for professional advice where professional advice is appropriate.
You remain responsible for your business records, tax obligations, contracts and compliance requirements.
6. GST and tax settings
JobWorth may allow you to configure GST or other tax-related settings for quoting purposes.
You are responsible for confirming that the tax treatment used for your business and customer quotes is appropriate.
JobWorth does not determine your legal tax obligations.
7. Document and invoice processing
JobWorth may allow you to photograph or upload invoices, receipts or other documents and may use automated processing to identify information contained in them.
Extracted information may be incomplete, inaccurate or incorrectly matched.
You must review relevant detected information before confirming important changes to your business costs.
JobWorth should not be treated as the authoritative record of a supplier invoice or accounting transaction.
8. Maps, routes and travel estimates
Route, distance, location and travel-time information may rely on third-party mapping services.
Routes and estimates can differ from actual conditions because of traffic, road closures, access restrictions, weather, vehicle restrictions, location accuracy or other circumstances.
You are responsible for determining whether a route is safe, lawful and suitable for the vehicle and job concerned.
JobWorth is not a navigation or road-safety service.
9. Vehicle information
JobWorth may allow vehicle information to be entered manually or, where available, obtained or assisted through external data services.
Vehicle data supplied by an external provider may be incomplete or unavailable.
Registration lookup does not determine a vehicle’s actual working payload, operating cost, tank capacity or suitability for a particular job.
You are responsible for confirming vehicle specifications and legal operating requirements relevant to your work.
10. Customer quotes
JobWorth can help you prepare customer-facing quotes using information you provide.
You are responsible for reviewing a quote before sending it and for the commercial agreement ultimately made between your business and your customer.
JobWorth is not a party to the agreement between you and your customer.
Internal JobWorth costing information, including true cost, margins and pricing calculations, is intended to assist your business and may differ from the information displayed to a customer.
11. Your data and responsibilities
You are responsible for ensuring that information you enter or upload to JobWorth is information you are authorised to use.
You must not knowingly use JobWorth to upload or process:
- unlawful material;
- malicious software;
- material that infringes another person’s rights;
- information you have no right to collect, use or disclose.
If you enter customer personal information, you are responsible for handling that information appropriately in your own business.
Our handling of personal information is described in the JobWorth Privacy Policy.
12. Beta access
JobWorth may be provided as a private beta before general commercial release.
Beta functionality may change as the product is tested and improved.
We may fix, change, add or remove beta functionality where reasonably necessary for testing, security, reliability or product development.
Beta access may be provided for a limited period.
If beta access expires, we may restrict the ability to create or edit information until access is extended or a future paid subscription is activated.
We do not intend beta expiry itself to automatically erase your workspace. However, you should maintain copies of important business information and customer documents you need for your own records.
Participation in the beta does not guarantee continued access to JobWorth or acceptance into a future paid service.
Beta testers who later choose to become Founding Subscribers may be offered special founding-member terms or pricing. Any such offer will be communicated separately before paid subscriptions open and will be subject to the terms of that offer.
13. Availability
We aim to provide a useful and reliable service, but JobWorth may occasionally be unavailable because of maintenance, updates, internet or service-provider outages, technical problems or circumstances outside our reasonable control.
Some functionality may require internet access or third-party services.
Offline functionality may be limited.
14. Third-party services
JobWorth may rely on or connect with third-party services, including mapping, cloud processing, document processing, application distribution and future accounting or business platforms.
Third-party services may have their own terms, privacy policies, availability and limitations.
We are not responsible for the independent operation of a third-party service, subject to any rights you have under applicable law.
15. Acceptable use
You must not:
- attempt to interfere with JobWorth’s operation or security;
- gain unauthorised access to systems, accounts or information;
- reverse engineer or misuse JobWorth except to the extent a restriction is prohibited by law;
- use JobWorth to conduct unlawful activity;
- use automated methods to overload or abuse the service;
- impersonate another person or business;
- knowingly provide malicious content.
16. Intellectual property
JobWorth, including its software, branding, design and original content, is owned by or licensed to Buzz Business Boosters and is protected by applicable intellectual property laws.
These Terms give you permission to use JobWorth in accordance with the service made available to you. They do not transfer ownership of JobWorth or its intellectual property to you.
You retain ownership of business information and content you provide to JobWorth, subject to the rights reasonably necessary for us and our service providers to process that information to provide, maintain, secure and improve the service.
17. Subscriptions and paid plans
JobWorth is currently being tested before its broader paid offering is finalised.
Paid subscription prices, billing periods, inclusions, renewal arrangements and cancellation terms will be clearly disclosed before a user enters a paid subscription.
These Terms do not create an obligation for a beta tester to purchase a paid subscription.
Additional subscription terms may apply when paid plans are introduced.
18. Consumer rights
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights that may apply under the Australian Consumer Law.
Where JobWorth is supplied to you in circumstances where statutory consumer guarantees apply, those rights continue to apply.
19. Liability
To the extent permitted by law, JobWorth is not responsible for losses resulting solely from business decisions made using incorrect, incomplete or outdated information supplied by the user or a third-party data source, or from a failure to review information that JobWorth clearly presents for confirmation.
Nothing in these Terms is intended to exclude or limit liability where doing so would be unlawful.
20. Suspension or termination
We may suspend or restrict access where reasonably necessary because of:
- serious or repeated breach of these Terms;
- unlawful or abusive use;
- security risks;
- non-payment under a future paid subscription;
- expiry of beta or subscription access;
- circumstances where continuing access would create a material security, legal or operational risk.
Where reasonably practicable, we will provide notice or information about the restriction.
Ending access does not automatically transfer ownership of your business information to JobWorth.
21. Changes to JobWorth and these Terms
JobWorth will continue to develop.
We may update the service and these Terms from time to time.
If a change to these Terms materially affects existing users’ rights or obligations, we will take reasonable steps to communicate the change where required or appropriate.
The current Terms will be published on the JobWorth website with their updated date.
22. Governing law
These Terms are governed by the laws applicable in New South Wales, Australia, subject to any rights or protections under Australian law that apply regardless of this provision.
